Court rules Texas acted improperly in seizing FLDS children…

SAN ANGELO, Texas — “A state appellate court has ruled that child welfare officials had no right to seize more than 400 children living at a polygamist sect’s ranch.”

“The appellate court ruled the chaotic hearing held last month did not demonstrate the children were in any immediate danger, the only measure of taking children from their homes without court proceedings.”

And pay attention to this quote from the SLT: “[Authorities for CPS] had admitted by midday Thursday that 15 of the 31 mothers listed as underage are adults; one is actually 27.

A few are as young as 18, but many are at least 20.Another girl listed as an underage mother is 14, but her attorney said in court she is not pregnant and does not have a child.” – Read the whole article HERE.

From my hometown newspaper in Texas: “The way that the courts have ignored the legal rights of these mothers is ridiculous,” said Texas Rural Legal Aid attorney Julie Balovich, who also represents FLDS mothers. “It was about time a court stood up and said that was has been happening to these families is wrong.”
“It is a great day for families in the state of Texas,” Balovich added later. “It’s a great day for justice in Texas. It was the right decision.” Read this article from The Houston Chronicle

Court rules Texas acted improperly in seizing FLDS children: “The court ruled the FLDS sect’s belief system alone did not endanger the children, and that the ranch should not have been treated as one household, Balovich said… Attorneys for FLDS children have been arguing the state has not shown individual children were abused or in danger…” Click HERE

“The state never provided evidence that the children were in any immediate danger, the only grounds in Texas law for taking children from their parents without court approval, the appeals court said.
“It also failed to show evidence that more than five of the teenage girls were being sexually abused, and never alleged any sexual or physical abuse against the other children, the court said.” From Yahoo News

Let’s just pray these poor families are reunited quickly and that God would use this nightmare to draw these folks to Himself! May God be glorified even in this!

I do not believe in polygamy but I am SO glad these children will be reunited with their mothers. IF any laws were broken, those childrens’ place is with their mother until things get straightened out.

Praise be to God! It’s about time someone came to their senses. This is good news to hear after I just read a headline on Yahoo news about the state of California needing to change the wording of their marriage license forms from bride and groom to ???? who knows what — party A and party B perhaps. Sigh :(.

I am so thrilled by this news. I honesty never thought it would turn out this way. I was heart sick over it all but I am thankful and praising God for His care and provision. I pray these families are quickly reunited and that the healing can start. I pray that God’s goodness shines through this whole ordeal and that hearts are turned to Him.

I just saw this on the news and knew you would have something posted! It is a great victory for all families.
Yes, we should continue to pray for these children – the interference of government agencies is not over, they will likely appeal the court decision and continue to keep the children with that legal move.
I don’t mean to be negative, but it would be truly amazing if CPS admits defeat. Again, leave it with the Lord.

Praise God! May the ruling stick and the children swiftly be reunited with their families.

May the Lord heal any wounds and cause their hearts to be turned to Him, so that they see the Truth.

Maybe some of these children should be re-united, but surely the ones who are being abused should be kept out of harms way. It’s a really messy situation.

  12. Amy says:

I’m glad those kids might go home, if they’ll be better off their.

That big poofy bouffant hair is how I do my hair in the shows I’m in sometimes! Ranging from 1870s-1915. Crazy that people still do that.! Strangely enough, the theatre I work at is owned and run by Mormons. Just regular Mormons, though (LDS), NOT polygamists.

  13. Jennifer says:

I think this is wonderful on so many levels: the mothers got their children, the children got their mothers, it’s been proven that NOT all Mormon children are treated the same (bad) way, the government has gotten a lesson on proper protocol!

And last (and least), the liberals will finally shut up (sorry, had to count that :P)

“May God be glorified even in this”

    Amen!!

This is one reason why CPS may have “over reacted” http://www.foxnews.com/story/0,2933,358845,00.html

I was wrong in my earlier words; this has not been a fortunate occurence at all. It is good that the mothers got their children and the government was reprimanded, but I wish abuse had been shown and the children were freed WITH their mothers. My one satisfaction with this entire thing is that the men in this group knew what it was like to have all control ripped out of their hands. That’s right: you polygamous abusers are not gods of your own world.
